Arguments for Nextcom interdict get underway

Morning arguments in Nextcom`s application for an interdict preventing communications minister Ivy Matsepe-Casaburri from issuing the third cellular licence revolved around the urgency of the matter.

Advocates for the department of communications have asked the court to strike the matter from the roll with cost, as the minister has not made her decision.

Judge Nico Coetzee ruled that the matter is urgent and will hear the case. The reasons are to be given in the judgement at a later date.

Chris Loxton, senior council for Cell C, asked the court to warn journalists to report accurately on proceedings and to warn bidders against inaccurate press releases. He was reacting to a press statement released by Nextcom earlier this week. Judge Coetzee did so after Nextcom`s council apologised for the release.

Argument on the selection process and for a full judicial review continues.
