A case filed by Econet Wireless seeking to annul the cancellation of its Kenyan licence has been referred to the chief justice.
High Court judge, Justice Joseph Nyamu referred the matter to Chief Justice Evan Gicheru to appoint a bench to hear and determine the case.
Econet filed the case in December 2004, seeking orders to reverse the cancellation of the licence that allowed it to be the third global system for mobile communication (GSM) provider in the country.
The company also wants the court to quash the minister's decision directing that the licensing procedure for the third GSM start afresh.
Econet wants the information ministry or its agents stopped from interfering with any matter relating to the third GSM licence, which had been granted by Communication Commission of Kenya on 10 November 2004.
