Third cell licence bidder Nextcom has been granted a temporary interdict preventing communications minister Ivy Matsepe-Casaburri from awarding the third cellular licence.
In his judgement, Judge Nico Coetzee said Nextcom had shown a prima facie case of irregularities in the adjudication of the licence.
Judge Coetzee also determined that the SA Telecommunications Regulatory Authority recommendation is a reviewable decision, opening the door for the full judicial review with which Nextcom will now proceed.
The matter is expected to be back in court as early as September.
